How will immigrants vote in the elections? The CEC draft is clarified: Apply 60 days before
The proposal of the CEC for the voting method of immigrants living abroad in the elections is clarified.
Immigrants apply to vote online, on the website of the CEC.
Immigrants apply to vote 60 days after the elections, those immigrants who live abroad for more than 3 months have the right to vote.

Every Albanian citizen with the right to vote, residing outside the territory of the Republic of Albania for a period longer than three months without interruption or for a period longer than six months, in a calendar year according to the provisions of Law No. 14/2016 “On the identification and registration of the address of Albanian citizens who live outside the territory of the Republic of Albania”, from here on in this decision, the person referred to as “voter from abroad”, has the right to vote where he has his residence , after having expressed the will to vote, according to the rules defined in this decision.
The procedure for submitting requests for the registration of voters from abroad begins no later than 15 days from the date of the announcement of the decree of the President of the Republic on setting the date for the elections to the Assembly and ends no later than 60 days before the date of the elections.
The request for registration is made by the voter from abroad, to the Central Election Commission (CEC) through its official website, or through an application that can be installed on various smart devices, approved by the CEC.
The voter from abroad who wants to register must complete the data required in the relevant electronic form which is made available according to point 3 of this decision.
The relevant electronic form contains data on: name, surname, date of birth, place of birth, personal identification number, address of permanent residence outside the territory of the Republic of Albania, a functional mobile phone number, a valid e-mail address. the foreigner must also attach (upload) to the above data a photo of his identification document issued by the Albanian state and/or by the state where he resides.
The commissioner through the administration of the CEC certifies the will of the voter from abroad to be registered, through his biometric identification, or through another way with electronic means, which is fully assured of the authenticity of the identity of the voter who made the request for registration. In case of non-functioning for technical reasons of information technology systems and equipment, the procedures for registering voters from abroad will be carried out according to the Order issued for this purpose by the State Election Commissioner, which is published and publicly consulted on the official website of the CEC.
The CEC has the right to verify the compliance of the data of the relevant electronic form filled in by the voter from outside his data in the National Register of Civil Status (RKGjC). If the voter from abroad has not declared his residence in accordance with the provisions of Law 14/2016 “On the identification and registration of the address of Albanian citizens living outside the territory of the Republic of Albania” and the legal acts issued pursuant to it or the data of the relevant electronic form do not match those of RKGjC, then the registration request is rejected. In this case, the voter from abroad is notified of the rejection via e-mail, or telephone message, or automatically after applying for registration via the CEC’s official website, or the relevant application. The voter whose request for registration was rejected has the right to re-apply respecting the deadlines set in this decision.
The CEC includes in a special list the names and other identification data of voters from abroad whose request to register to vote where they have their residence abroad, hereinafter referred to as the Index of Foreign Voters (IVJ) .
With the exception of voting from abroad for the first time, in the subsequent elections for the Assembly and the following, the CEC will have to, in interaction with the DPGjC, update the addresses abroad declared by the voters from abroad who are currently registered in the IVJ . In any case, in accordance with the provisions of the Electoral Code, voters will have to express their will to exercise the right to vote, according to the rules defined in this decision, without the need to provide again data or documents that they have put in previously available and have no changes. The Central Election Commissioner approves by Order the procedures for storing and updating the information held by the IVJ.
Not later than 45 days before the date of the elections, the CEC sends the IVJ to the General Directorate of Civil Status (DPGJC).
The DPGJC draws up the list of voters according to the provisions of Article 56 of Law No. 10019, dated 29.12.2008, “Electoral Code of the Republic of Albania”, as amended, removing from this list the names of those persons contained in the IVJ.
DPGjC draws up the list of voters from abroad according to the provisions of Article 46, paragraph 3, of Law No. 10019, dated 29.12.2008, “Electoral Code of the Republic of Albania”, as amended.
Electoral subjects registered in these elections in the Central Election Commission, at their request and free of charge, can receive from the General Directorate of Civil Status and/or the Central Election Commission an electronic copy of the lists of voters from abroad.
In the case where the request for registration is accepted, then the CEC notifies the voter from abroad that he will be removed from the list of voters who vote within the territory of RSH and that he will be provided with a ballot to vote where he has his residence.
In the case of early elections, the procedure for submitting requests for the registration of voters from abroad begins no later than 2 days from the date of the announcement of the decree of the President of the Republic on setting the date for the elections to the Assembly and ends no later than 15 days before the date of elections.
The representatives of political parties in the CEC have the right to familiarize themselves in advance with all systems and/or information technology equipment that ensure the process of registering voters from abroad according to the provisions of this decision.
Information technology systems and equipment used for the purposes of implementing this decision are subject to a preliminary test in the presence of political parties, media and various civil society organizations, etc.
This decision enters into force immediately and is published on the official website of the CEC.
An appeal can be filed against this decision in the Judicial Electoral College at the Administrative Court of Appeal, Tirana, within (5) days from the announcement of this decision.
