The family of the well-known journalist is looking for two hectares of land in Veternik
For the third time in a row, the Police has been forced to stop the works on a property located in the Veternik neighborhood of Pristina.
Nexhat Sadiku claims that the land of over 2 hectares is his property, which has been in legal dispute since 1984.
According to Sadik, a group of people took the land from him and within 9 months managed to transfer it to their name.
He adds that there are evidences and well-founded suspicions that this whole process is rigged.
“The land was inherited from my father and grandfather. All the Kojshis know us here because we worked the land before the war. Nobody knows these new owners who claim that the land is theirs. The witnesses are alive. We have many documents and proofs that prove that this property belonged to my family more than 60 years ago. We have the title deed, certificates that we have paid money for this land, certificates that the land has been in our name, certificates that we have not received compensation for the land, etc. In 1962, the land was taken from us by the state.
“The Special Chamber has recognized the ownership right of Mrs. Hysen with a decision, because the land that was previously taken from you by the state has been returned to them. The date of the document is Saturday. When they made the falsification of the document, they did not consider that that date is a holiday when the courts do not work.
This document is based on recognizing the right of ownership to Ms. Hysen.
In 1983, when the aerial photography was done, we realized that the land appears in the name of PIK and we filed a lawsuit in 1984.
Until 1987, 3 hearings were held in the Municipal Court, then the case was transferred to the District Court. In 1988, my father died and the landa rested. After we did the inheritance from the father in the Municipal Court, we continued the case in 2001 in the Basic Court. Landa with number 1161/01, while the judge was Sanije Muçolli.
The representatives of the Agricultural Combine have been invited to court hearings 3 times, since then they have appeared as owners, but they have not come. At that time, it was the practice of the Courts that if it is proven that the invitation was delivered to the party and it did not justify its non-appearance, the Court decided in favor of the plaintiff party. But judge Muçolli decided that the expertise of the land should be done and it was done by Sharr Pllana. In 2004, the Basic Court ruled that it was declared incompetent for the settlement of social properties and that the Special Chambers of the Supreme Court decide on them. Until 2017, we were not invited by the Special Chambers because the situation was prolonged for someone’s interests. Meanwhile, in 2014, a group of people appeared and transferred the land within 9 months, which has never happened in history to resolve such a dispute in such a short time.
“We are the legitimate owners and we have reasonable suspicions and evidence that this group has forged documents and signatures,” Sadiku declares.
The Sadiku family filed a criminal complaint and sent all the evidence to the prosecutor’s office, but according to them, the prosecutor’s office, Bukurije Gjonbalaj, is not taking any concrete measures.
Meanwhile, journalist Arlind Sadiku, Nexhat’s son, says that he communicated personally with the American ambassador Jeffrey Hovenier about this case and he thanked him for addressing it as a concern. Sadiku has also informed the Ministry of Internal Affairs and the Ministry of Justice.
“We suspect that this is an organized crime, where most of the justice institutions are involved. In this case, there are manipulations by the Economic Crimes, the KPA, the Prosecutor’s Office, the Judiciary, etc. Guess what the biggest scandal is. The jury composed of Behxhet Muçiqi, Teuta Ibrahimi and Witold Jakimko in 2015 decided to transfer this property to the name of Mrs. Hysen, who died only 2 days after the Decision. Then, the same judges, for the same property, held court hearings with my family in 2017, 2018, and 2019. This is scandalous. This fact alone is enough for prosecutor Bukurije Gjonbalaj to act. After the death of Mrs. Hysen, the property was transferred to the name of Ylber Hysen. Within a record time, without respecting any legal deadline, it has been partialized in many properties. Most of the current owners of our land are high public figures who are related to justice. We have reasonable suspicions that these owners have not made any banking transactions to become owners of the plots,” says Arlind Sadiku.
Some of the new owners were present today at the land, observing the prohibition of the works by the Police and they refused to give a statement, claiming that they have the documentation in order.
The Sadiku family says they are ready to protect their property in any way and calls on the institutions of Kosovo to bring justice in this case as soon as possible.
